Hyatt believes Google was aware of the defect and cites as evidence an article titled “Help stop your Pixel phone from feeling too hot or hot” on the company's website. The plaintiff claims that, even though it was aware of the defect, Google failed to warn consumers that the Pixel 6 Pro had a tendency to overheat and marketed it as if nothing was wrong with the device.
Hyatt wants to represent California consumers who purchased the Pixel 6 Pro in the state. The lawsuit states that Google is guilty of violating the California Consumer Legal Remedies Act, the False Advertising Act, the Unfair Competition Act and the Song-Beverly Consumer Guarantee Act.
It remains to be seen whether the lawsuit will go to trial or be dismissed in court.
